Bid Protests Cases
We have two bid protest cases involving “best value procurement” methods in federal contracts. One bid protest case comes to us from the General Accounting Office and the other from the Federal Court of Claims. Subcontractors played an important role in achieving superior ratings for the winning bidders, and neither protestor was able to prove the basis for the award was either unreasonable or arbitrary.
Bid Withdrawal
In another bid-related case, a contractor successfully overcame a public district’s attempt to take advantage of a bid error. To close out this week’s issue, we included in our Tips section a summary of the various issues contractors should consider in preparing and/or protesting a bid as reflected in the reviewed decisions.
