ASBCA PERMITS SUB TO SUE U.S. FOR NON-PAYMENT BY PRIME

The Armed Servcies Board of Contract Appeals (ASBCA) held that, a contract modification permitting the government to issue a two-party check to the general contractor and a subcontractor gave the subscontractor third-party beneficiary status under the contract, giving the Board jurisdiction to hear the subcontractor's appeal from the contracting officer’s denial.
