ASBCA DISMISSES CASE FOR LACK OF JURISDICTION PURSUANT TO FEDERAL CIRCUIT REMAND

This summary provides an update for a case we first reported in our Feb. 9, 2004 issue. The Armed Services Board of Contract Appeals had awarded a termination settlement to the contractor, which was vacated for lack of jurisdiction by the US Court of Appeals for the Federal Circuit. On remand, the Board dismissed the case, as the contractor has not submitted a separate termination cost proposal.
