EDITOR'S NOTES | Issue 2-22
publication date: May 30, 2004
This week’s Advisor has a diverse set of cases. A California court awarded damages for latent defects to subsequent owners of a home against the original builder. This is certainly to be controversial since the current owners did not sign the contract with the original builder. Also reviewed is a case where a general contractor unsuccessfully tried to recover from a bankrupt subcontractor’s insurance for defective work, a ruling in Alaska upholding a new mechanical code, and the reconsideration of the ASBCA’s decision on the Perini appeal for late finish of the Venezuelan Embassy. The Digest section reviews the cases selected as highlight of 2003 by the Public Contract Law Section of the American Bar Association. In Tips and Techniques, attorney Jayne Czik provides general contractors extra precautions to take to enforce subcontractor quotes.
