The first two cases in this issue have a common theme, failure to follow correct business practices can result in lost court cases. In the NCDOT case, a claim for additional costs was submitted late and with improper documentation. In Rayner v. Reeves, the owner of the corporation executed a contract with his personal signature instead as an officer of the corporation. As a result, the court found him personally liable. The third case this issue involves a subcontractor who relied on a distributor’s price announcements without verification. Subcontractor I&R Mechanical was unable to enforce the distributor’s misquoted price and ended up eating a $43,000 discount.
