In the first two cases covered this week, two courts reached opposite conclusions on the same issue. The first is a Missouri case where a trial court's award of lost profits was upheld on appeal in a breach of contract action involving cardinal change on a project for a non-profit public agency. In the second case, the California Supreme Court reversed the lower courts' rulings and declared lost profits were not recoverable. The third case this week involves whether a subcontractor's design consultant owes a duty of care to a general contractor or project owner.
