Surety Payments Here are two surety cases involving improper payments. In PSE, the surety was found to have made a payment in bad faith and could not recover from the contractor under the indemnity clause. In Penn National, a municipality released funds to a contractor that rightfully belonged to the surety. Both of these cases are mandatory reading for sureties, their agents and their attorneys, and are of interest to contractors. As-Built Schedules As-built schedules are an essential component of any delay claim. Whether or not CPM schedules are kept up to date during the course of the job, it is frequently necessary to create or recreate a detailed as-built schedule to support a delay claim. In this issue, we look at several methods available for the purpose of delay analysis and support.
