Because, in part, of how a contract was drafted, a developer lost the opportunity to convert a temporary interest in a piece of property into a permanent interest. The district court dismissed the claim, holding that it was barred by the statute of limitations. The appeals court reversed, in part, holding that the harm was not evident to the developer until after it lost its case to the property owner, and therefore, its case against the law firm was not barred by the statute of limitations.
