DAVID J. MITCHELL, P.E.
David J. Mitchell is a Principal in the San Francisco office of Navigant Consulting, Inc. Prior to joining Navigant Consulting, Mr. Mitchell was a Vice President of The Barrington Consulting Group, Inc and had been a Senior Consultant with Peterson & Co. In addition, Mr. Mitchell previously held a number of construction management positions with the Bechtel Group, Inc., including Project Cost/Schedule Engineer, Construction Superintendent, Project Construction Coordinator and Contract Administrator. In addition, Mr. Mitchell held the position of Construction Division Scheduler at the Lawrence Livermore National Laboratory. Mr. Mitchell began his professional career as an Instrumentation and Controls Engineer with Gilbert Commonwealth Co.
Educational Background and Professional Certifications
Mr. Mitchell received his Bachelors degree in Business Administration from the University of California, Berkeley, concentrating in Finance and Economic Analysis. He also earned an Associates degree in Electronic Engineering Technology at the Ohio Institute of Technology.
Mr. Mitchell is a registered professional engineer in California (License #E11189) and Pennsylvania (License #027673E).
Professional Experience
Mr. Mitchell has over 13 years of experience consulting on a wide variety of construction schedule delay and damage claims for numerous owners, architect/engineers, contractors and subcontractors. He has reviewed and prepared construction claims that have included schedule delay and disruption issues related to design problems and clarifications, contractor performance, material delivery, changes in contract scope, suspensions in performance, adverse weather, contractor/subcontractor coordination, defective construction, third party reviews, subcontractor substitutions, constructive acceleration, differing site conditions, wrongful termination, hazardous waste remediation/disposal as well as other factors.
In addition, Mr. Mitchell has reviewed and prepared claims for cost issues including bid estimate validity, labor inefficiencies, material price variances, acceleration costs, unresolved extra work, proper cost allocations, quantity and productivity variances, changed work conditions and extended field and home office overhead.
Mr. Mitchell's claims consulting experience covers a diverse variety of construction projects including power generating facilities, hospitals, airports, correctional facilities, steel mills, convention centers, transmission lines, office buildings, water control structures, highways, bridges, commercial shopping centers, housing projects, educational facilities, pipeline compressor stations, fiber optic telecommunications, refineries, and wastewater treatment facilities.
Beyond his construction claims consulting experience, Mr. Mitchell has provided clients with a range of consulting services focused on the effective mitigation or resolution of contract disputes. These services include the development and implementation of training programs in topics such as CPM Schedule Analysis techniques, Construction Contract Administration, use of Dispute Review Boards, and Effective Presentations. Mr. Mitchell has also provided clients consulting services related to process evaluation and effectiveness improvement in areas such as Contract Change Orders, Dispute Resolution, Scheduling Specification and Administration and responding to Differing Site Conditions Claims.
In addition to Mr. Mitchells construction claims experience, he also has over 12 years of construction management and design engineering experience. As a Contract Administrator, he was responsible for the financial and administrative management of 75 active contracts valued at more that $375 million. As a Construction Division Scheduler, he developed and implemented a computer-based program for allocating resources, scheduling job work orders, tracking project costs and analyzing cost and schedule trends. As a Project Construction Coordinator, he developed a program for the systematic resolution of engineering-related construction problems, monitored engineering, construction and procurement interfaces and coordinated multi-discipline problem resolution. As Systems Completion Superintendent, he was responsible for the development and implementation of a program that ensured the completion of the construction scope necessary to support pre-operational/start-up testing milestones. In all of these capacities, he developed extensive experience in system design, contract and subcontract administration, claims analysis and resolution, construction engineering, cost and schedule analysis and the effective development and implementation of project control tools.
Testimony Experience
Mr. Mitchell has provided testimony as an expert witness on CPM scheduling analysis and claims pricing issues in Sacramento County Superior Court and Santa Clara Superior Court as well as in Arbitration and Mediation settings.
