Reduction In Scope Of Site Clearing May Still Lead To Added Costs; Contractor’s Scheduling Consultant’s Fees May Be Compensable

On a sewage treatment facilities improvement contract, a scope change reducing the construction site area to be cleared and graded would not necessarily result in a reduction in the contract dollar amount, where the area reduction is also a constriction of the mobilization area around the construction site. The equitable adjustment of increased time and/or payment for the contractor is an issue of fact for trial, the U.S. Court of Federal Claims rules.
