SUBCONTRACTOR LIABLE FOR ITS EMPLOYEE’S INJURIES – PRIME AND CONSTRUCTION MANAGER OFF THE HOOK

Illinois Court of Appeals (Sixth Division)

The Circuit Court of Cook County dismissed the claims of a subcontractor’s employee against the prime contractor and construction manager for a personal injury sustained at the worksite. The appellate court affirmed the Circuit Court’s decision, rejecting common exceptions to the "oversight" rule and the plaintiff's assertion that the beam that caused the accident was a defective "product."
