COURT ALLOWS INSURANCE COMPANY TO BE SUED

United States Court of Appeals for the Fourth Circuit

This case involves an appeal from the United States District Court for the Eastern District of Louisiana. The District Court had denied the claim of a building owner against the Louisiana Guaranty Association, the successor to the builder’s original property insurer. The Fourth Circuit reversed the District Court’s decision and remanded the case, allowing the insurer to be sued for mold damage expenses.
