TRIAL COURT’S DISCHARGE OF $1.7 MILLION LIEN AGAINST GENERAL CONTRACTOR PUT ON HOLD

Superior Court of New Jersey, Appellate Division

Subcontractors filed a $1.7 million construction lien against the general contractor, alleging that the general contractor had not paid over $1.7 million in overrun fees and charges. The trial court discharged the lien and ordered the subcontractors to pay the general contractor’s attorneys’ fees. On appeal, the Appellate Court of New Jersey disagreed with the subcontractors substantive complaints, but agreed on some procedural issues, remanding the case back to the trial court.
