FORMAL DECLARATION OF DEFAULT NOT REQUIRED TO TRIGGER PERFORMANCE BOND OBLIGATION

A state high court determines that a formal contract default declaration is not necessary to trigger a suretys performance bond obligation on a subcontract. The prime contractor fulfilled its contractual requirements to trigger bond coverage. However, two justices disagree.
