PENDING SEPARATE CLAIMS UNDER THE CONTRACT DO NOT PRECLUDE “PREVAILING PARTY” STATUS

A contractor may have “prevailing party” status in a suit involving a single claim while other claims still await judgments in other courts. Prevailing status is awarded on a per-case basis, not on an awarded grand total of all suits filed in various jurisdictions.
